BUYER:
The Buyer's full name, address, telephone number, and email address are the details provided by the Buyer during the order process.
ARTICLE 2 – SUBJECT
The purpose of this Agreement is to define the rights and obligations of the Parties regarding the sale and delivery of the product(s) ordered electronically by the Buyer through the Seller's website, happypawsdeals.pet, in accordance with the provisions of the Turkish Consumer Protection Law No. 6502 and the Regulation on Distance Contracts.
ARTICLE 3 – PRODUCT INFORMATION
The type, category, quantity, brand/model, sale price, payment method, and delivery details of the product are specified in the order form on the Seller's website and in the invoice/order confirmation email. These details form an integral part of this Agreement.
ARTICLE 4 – GENERAL PROVISIONS
4.1. The Buyer acknowledges, declares, and undertakes that they have read and understood the preliminary information provided on the Seller's website regarding the essential characteristics of the product, the total sales price including all applicable taxes, payment method, delivery terms, and delivery costs, and that they have confirmed this information electronically.
4.2. The product subject to this Agreement shall be delivered to the address specified by the Buyer within the estimated delivery period stated on the Seller's website (generally 7–14 business days), provided that the statutory maximum delivery period of 30 days is not exceeded.
4.3. If the product is to be delivered to a person or organization other than the Buyer, the Seller shall not be held responsible if such person or organization refuses to accept the delivery.
4.4. Delivery of the product is conditional upon this Agreement being approved electronically and the product price being paid using the payment method selected by the Buyer.
ARTICLE 5 – RIGHT OF WITHDRAWAL
5.1. The Buyer has the right to withdraw from this Agreement within 14 (fourteen) days from the date the product is delivered to the Buyer or to the person or organization designated by the Buyer, without providing any reason and without incurring any penalty.
5.2. To exercise the right of withdrawal, the Buyer must notify the Seller in writing via happypaws.deals@gmail.com within the withdrawal period. The product must be returned unused, in resalable condition, together with its original packaging and invoice, in accordance with Law No. 6502 and the applicable regulations.
5.3. The product price shall be refunded to the Buyer within 14 days following the Seller's receipt of the withdrawal notice.
5.4. The right of withdrawal may not apply to products exempted under applicable legislation, including but not limited to cosmetic products, underwear, custom-made or personalized products, perishable goods, and products that cannot be resold for hygiene or other legal reasons.
ARTICLE 6 – DEFAULT AND LEGAL CONSEQUENCES
If the Buyer's payment instrument is unlawfully used by unauthorized persons and, as a result, the relevant payment institution does not pay the product price to the Seller, the Buyer shall return the delivered product to the Seller within 3 (three) days.
ARTICLE 7 – COMPETENT AUTHORITY
Any disputes arising from the implementation of this Agreement shall be subject to the jurisdiction of the Consumer Arbitration Committees for disputes up to the monetary limits announced by the Ministry of Trade of the Republic of Türkiye, and the Consumer Courts for disputes exceeding those limits.
ARTICLE 8 – EFFECTIVENESS
By placing an order through the Seller's website, the Buyer is deemed to have read, understood, and accepted all the terms and conditions of this Agreement.
